Terms of Use

1. Acceptance of these Terms

These Terms of Use (the "Terms") govern your access to and use of the FundMyPrediction website, applications, and services (together, the "Platform", operated by "FundMyPrediction", "FMP", "we", "us"). By creating an account, purchasing a challenge, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, do not access or use the Platform. We may modify these Terms at any time (see Section 15); continued use after changes take effect constitutes acceptance of the updated Terms.

2. What the Platform is

FundMyPrediction is a skill-evaluation service for prediction-market trading. When you purchase a challenge, you receive access to a simulated trading account with a virtual balance. Your simulated orders are priced against live, third-party prediction-market data (including publicly available Polymarket market data), but no real orders are placed on any market on your behalf, and none of your money is ever staked, wagered, or invested in any market. Your challenge fee pays for access to the evaluation and the Platform's tools — it is not a deposit, a stake, or an investment.

Each challenge has published parameters — for example a profit target, maximum daily loss, maximum trailing drawdown, and minimum number of trading days — shown at the time of purchase and inside the Platform. Passing a challenge requires meeting all of its criteria. Breaching a risk rule ends the challenge. We may modify challenge parameters for future purchases; active challenges remain governed by the rules in effect when they were activated.

Completing all requirements qualifies you for a funded account. Funded accounts are also simulated, and remain subject to ongoing risk-management rules equivalent to the evaluation phase (including maximum daily loss and trailing drawdown), as shown in the Platform. Violating a funded-account rule ends that account. Profits generated in a funded account entitle you to real payouts under the profit split displayed for your account, subject to these Terms, our review process, and Section 7. We may suspend or terminate any funded account that we reasonably determine is engaged in the prohibited practices described in Section 8.

The Platform simulates fills against real market data, and real markets have imperfections. You agree not to exploit them. The following are strictly prohibited and may result in account termination and forfeiture of profits obtained through such conduct:

We may void trades, results, or accounts obtained through prohibited conduct or through Platform error, and may correct erroneous fills, marks, or resolutions so that results reflect genuine market conditions.

9. Not gambling, not investment advice

The Platform is a simulated-trading evaluation service. You never bet, wager, or risk money on market outcomes — your only payment is the challenge fee for the evaluation service itself. Nothing on the Platform is investment, financial, legal, or tax advice; market data, prices, charts, and commentary are provided for informational purposes only. FundMyPrediction is not a broker, exchange, or fund, and is not affiliated with, endorsed by, or connected to Polymarket or any other market operator whose public data appears on the Platform.

10. Affiliates and referrals

Our affiliate programme pays commissions on qualifying referred purchases, at the rates shown in your affiliate dashboard. Commissions accrue only on genuine, paid purchases — self-referrals, test payments, refunded or charged-back purchases, and purchases produced by prohibited conduct do not qualify. We may adjust programme rates prospectively and may withhold commissions connected to fraud or abuse.

11. Intellectual property

The Platform, including its software, design, text, and branding, belongs to us or our licensors. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Platform for its intended purpose. Third-party market data remains the property of its respective owners.

12. Availability and changes

The Platform is provided "as is" and "as available". We do not guarantee uninterrupted operation, and third-party data feeds may be delayed, incomplete, or wrong. We may modify, suspend, or discontinue any part of the Platform. Where reasonably possible we will give notice of material changes.

13. Limitation of liability

To the maximum extent permitted by law: we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill; and our total liability for all claims arising out of or relating to the Platform is limited to the total fees you paid us in the twelve months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded.

14. Indemnity and termination

You agree to indemnify us against claims, damages, and reasonable costs arising from your breach of these Terms or your misuse of the Platform. You may stop using the Platform at any time. We may suspend or terminate accounts that breach these Terms, with notice where practicable. Sections that by their nature should survive termination (including 8, 9, 11, 13, and this Section) survive.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version, and material changes will be announced on the Platform or by email. Continued use after changes take effect constitutes acceptance.

16. Governing law and contact

These Terms are governed by the laws of the jurisdiction in which the operator is established, and disputes belong to the courts of that jurisdiction, unless the law that applies to you requires otherwise.
